1. This Agreement:
This Agreement is a legal document which sets out your rights and obligations, and those of Halal and Tayyab ("Halal and Tayyab", "we", or "us") in relation to the Services offered by Halal and Tayyab through this site.
1.2 Place of performance and applicable law:
i) Halal and Tayyab is registered in England and every item purchased from Halal and Tayyab shall be deemed to have been purchased in the United Kingdom.
ii) English law shall govern the purchase of all items, and the conduct of users of the site. You and we each submit to the non-exclusive jurisdiction of the English courts in relation to disputes arising out of improper usage of Halal and Tayyab.
1.3 Effect of this Agreement:
There is no registration fee, and usage of Halal and Tayyab is free to visitors. However, by using this website you agree to the terms of this Agreement and you re-affirm that Agreement every time you use Halal and Tayyab website.

1.5 Change to this Agreement:
Halal and Tayyab reserves the right to change this Agreement from time to time, and will post the new version on www.fairtradewarehouse.co.uk. When we do so, we will notify you of this fact on the main screen. The new version will take effect and will govern all activity on or through the Halal and Tayyab site and your relationship with us, commencing 14 days after the date of such posting (or such later date as Halal and Tayyab indicates in the posting). If you do not wish to be governed by the new version of the Agreement, you may notify us within the above 14 day period, and from the date when the new version takes effect.
2. Terms which apply to all Customers:
2.1 Registration and Payment:
You undertake to register with Halal and Tayyab using your correct name, address and any other requested details. In order to pay for your order you will be asked to confirm the payment method; account customer, cheque, or to enter details of your credit/debit card (please note credit card payments incur additional card processing payments). You must ensure that;
i) You are fully entitled to use that card at the time when you enter its details on the Halal and Tayyab site, and when you seek to use it, and,
ii) It has available funds sufficient to cover all charges incurred on it in the course of your activities on the Halal and Tayyab site. If any of the information entered becomes incorrect or is superseded, then you must notify Halal and Tayyab with the correct information.
2.3 Misuse of Halal and Tayyab web site:
Halal and Tayyab reserves the right to not accept an order from a customer which is, or appears to be, in breach of any of the provisions in this Agreement.
The price of goods displayed on this site will not include VAT. VAT will be added to your order during the checkout stage.
3. Liability & general:
3.1 Halal and Tayyab Ltd intellectual property:
You acknowledge that all copyright, trade marks and other intellectual property rights in and relating to the Halal and Tayyab site are owned by Halal and Tayyab. You must not use any of those intellectual property rights, or the Halal and Tayyab site, except to the extent to enter into transactions in the manner anticipated in this Agreement.
3.2 Consequential loss:
We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise), even if that loss or damage was foreseeable by, or the possibility of it was brought to the attention of Halal and Tayyab.
3.3 Maximum liability:
Without limiting the preceding paragraph, the liability of Halal and Tayyab under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of (a) £250 or (b) an amount equal to the sums paid or payable by or to you in the transaction(s) to which such liability relates, regardless of the cause or form of action.
Nothing in this Agreement limits Halal and Tayyab's liability for death or personal injury from Halal and Tayyab negligence, or any other liability, which may not by law be excluded.
You agree to indemnify Halal and Tayyab against all liabilities, claims or expenses that may arise from any breach of this Agreement by you or through your Halal and Tayyab account.
Halal and Tayyab reserves the right to assign or subcontract any or all of its rights and obligations under this Agreement. If we exercise this right we shall name the assignee or subcontractor on the main screen and you will be entitled to terminate this Agreement immediately. You may not, without the written consent of Halal and Tayyab, assign or dispose of this Agreement.
3.7 Reasonable control:
Halal and Tayyab shall not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control.
In the event of conflict or inconsistency between the terms of the English version of this Agreement and any translation provided by Halal and Tayyab, the English version shall prevail.
In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of the Agreement shall remain valid and enforceable.
